Biography

Trishelea is a partner in the Employment Practice Group of Wong & Partners. Her practice focuses on employment and industrial relations, and maritime and shipping law.

Practice Focus

Trishelea has a significant employment law practice which extends to both contentious and non-contentious employment work. These include advising on employment law disputes and on a wide range of employment relationships and arrangements such as employee mobility, voluntary separation schemes and as part of spin off and carve out transactions and corporate reorganizations.

Trishelea also advises clients on maritime and shipping law which encompasses advisory and advocacy work in relation to cargo disputes, shipbuilding disputes, oil pollution claims, collision claims, detention of vessel by authorities and enforcement of ship mortgages under conventional and Islamic facilities. She has been recognized as a Next Generation Partner in Shipping in Malaysia by Legal 500 Asia Pacific. She is also involved in commercial litigation and has acted in novel cases of employee disputes and enforcement of foreign judgments or awards.

Representative Legal Matters

  • Advised and assisted in local and global level transactions of business transfers and share acquisitions, including conducting due diligence and drafting of contractual and employment terms.

  • Drafted and reviewed letters of offer, employment agreements, employee handbooks, secondment agreements, personal data notices and consents, show cause letters, warning letters and termination letters.

  • Advised local and multinational companies on voluntary separation schemes, and mutual separation schemes involving senior employees.

  • Advised on employment issues arising from retrenchment or closure of business.

  • Acted as counsel in constructive dismissal cases and direct dismissal cases on the grounds of poor performance and misconduct and retrenchment.

  • Advised and acted for charterers, shipowners and cargo interests in cargo, bills of lading and charterparty disputes.

  • Advised on oil pollution claims and environmental protection legislation in Malaysia.

  • Advised and acted in claim arising from a collision in the Straits of Malacca.

  • Acted as counsel for various claimants in arrest of vessels as security for claims in Malaysian courts and local and foreign arbitrations, and in applications for omnibus orders, sale of vessels and determination of priorities and payment out.
